More information can be found in “Information about cookies”.

2.3. On what legal basis do we use your personal data?

2.3.1. The basis for processing customers’ personal data is primarily the need to perform a contract to which the data subject is a party, or to take steps at the request of the data subject prior to entering into a contract (Art. 6(1)(b) GDPR). This applies in particular to personal data provided in the account registration form, when ordering and concluding a purchase contract or making a reservation in the online shop, as well as when subscribing to the newsletter. In the case of personal data provided to us in connection with a customer complaint, the legal basis for their processing is also the need to perform / handle the contract for the sale of the goods complained about.

2.3.2. In the case of processing for the marketing purposes stated above, with the exception of those carried out through the newsletter, the basis for this processing is the pursuit of the legitimate interests of the controller or its cooperating entities (Art. 6(1)(f) GDPR), in which case the cooperating entities do not take part in processing the customer’s data. On the other hand, where the controller’s partners may have direct access to this information, the legal basis for such processing is the voluntary consent given by the customer (Art. 6(1)(a) GDPR).

2.3.3. For other purposes, the customer’s personal data may be processed on the basis of:

2.3.3.1. voluntarily given consent – e.g. persons entering competitions (Art. 6(1)(a) GDPR);

2.3.3.2. a legal obligation – where processing is necessary for compliance with a legal obligation of the controller, for example when the controller accounts for concluded purchase contracts under tax or accounting legislation (Art. 6(1)(c) GDPR);

2.3.3.3. necessity for purposes other than those stated above that arise from the legitimate interests of the controller or a third party, in particular to establish, exercise or defend claims, to communicate with the customer, including through contact forms (including replies to customers’ messages), and for market and statistical analyses (Art. 6(1)(f) GDPR).

2.4. How long do we use the data?

2.4.1. Personal data may be kept for as long as the online shop is used (and may be deleted three years after the customer’s last activity in the online shop); in the case of marketing activities – until the customer objects; and in the case of cookies and similar technologies, depending on technical matters, until these files are deleted through the browser / device settings (deleting the files is not always the same as deleting the personal data obtained through them, which is why it is possible to object).

2.4.2. If the processing of personal data depends on the customer’s consent, the personal data may be processed until the consent is withdrawn.

2.4.3. In any case:

2.4.3.1. Personal data will also be kept where the law (e.g. accounting or tax legislation) requires the controller to process them;

2.4.3.2. Personal data will be kept longer in the event of a possible complaint by the customer against the controller, so that the controller can assert its claims, or where they are needed to assert or defend against claims of third parties, within the limitation period laid down by law, in particular by the Civil Code.

2.4.4. Depending on the scope of the personal data and the purpose of their processing, they may be kept for a different period. In any case, the longer of the retention periods applies.

2.5. Transfer of personal data to third parties

2.5.1. We use all personal data obtained from customers exclusively for the internal needs of the controller, protect them against misuse and do not provide them to third parties without prior notice or your consent. The exceptions are external companies that provide support services for us (e.g. transport, payments or e-shop development) and state authorities. We may or must provide your personal data to these companies to the minimum extent necessary for the smooth handling of the order or for the operation and improvement of the shopping process.

2.5.2. This concerns in particular the following activities:
